Terms of service

Last updated: 30 October 2026.

These terms are the agreement between you and XDive (https://xdive.dev), operated by Mehdi Sadeghian ("we", "us"), for using the XDive website, API, SDKs, command-line tool and MCP server (the "Service"). By creating an account or using the Service you agree to them. If you use the Service for an organization, you confirm you may bind it to these terms. Please read the privacy policy too.

What the Service does

XDive fetches public web pages on your request and returns them as Markdown, HTML or structured data, crawls and maps sites, runs web searches, and answers questions with cited sources. It is software that acts on your instructions: you decide what to fetch, and you are responsible for it.

Your account

  • You must give accurate information and keep your password and API keys secret. You are responsible for everything done with them. Revoke a key you think has leaked, under API Keys.
  • Access may be invitation-only. We can approve, hold or reject sign-ups, and can limit accounts or organizations that exceed fair use.
  • You must be old enough to form a binding contract where you live, and at least 16.

Acceptable use

You agree not to:

  • break the law, or use the Service to harm, harass, defraud or mislead anyone;
  • fetch, store or process content you have no right to, or breach the terms, access controls or robots.txt of the sites you fetch. The robots.txt check is on by default; turning it off is your responsibility;
  • use the Service to attack, overload or probe third-party systems, to reach private or internal networks, or to evade security measures such as logins, paywalls or CAPTCHAs you are not entitled to bypass;
  • collect personal data without a lawful basis, or use results to make decisions about people that the law restricts;
  • use the residential proxy, the connectors or the browser features outside the access your organization was granted;
  • resell or share the Service in a way that circumvents quotas or per-key budgets, create accounts to dodge limits, or interfere with the Service or other users;
  • reverse-engineer the Service's non-public parts, or use it to build a directly competing service by systematically copying its output.

We may remove content, throttle or suspend access, or close accounts that break these rules, and will tell you why where we can.

Content from the web and your data

  • Pages we fetch belong to their publishers. We give you no rights in them. Check that you may use what you collect.
  • You keep all rights in your own content and data. You give us only the permission needed to run the Service for you: to process, store and return it as described in the privacy policy.
  • The results of AI features can be wrong or incomplete. Check important answers against their cited sources.
  • Settings such as zero_data_retention and lockdown reduce what we keep, as described in the documentation. They do not change your own responsibilities.

Quotas, plans and payment

Each organization has monthly quotas for pages, searches and browser time, and API keys can have their own budgets. Over-quota requests are refused. XDive does not charge for use today. If we introduce paid plans, we will show prices before you commit, and changes will not apply retroactively to periods you have already used.

The Service is provided as it is

We work to keep the Service available and accurate, but it is an early product and comes without any warranty or uptime guarantee. Features and limits can change, and we may add, change or retire parts of the Service. We will give reasonable notice of changes that affect you significantly. Current status is at https://xdive.dev/status.

Software, SDKs and licences

The XDive SDKs and the command-line tool are open source under the MIT licence, which is the licence that applies to that code. The rest of the Service, including the server and the website, remains ours. Feedback you send us may be used to improve the Service without obligation to you.

Ending the agreement

You can stop at any time and delete your account under Profile. We may suspend or end your access for breach of these terms, for security or legal reasons, or if we discontinue the Service. When an account ends, the data deletion described in the privacy policy applies. Terms that by their nature should survive (such as liability limits) do.

Liability

To the extent the law allows:

  • the Service is provided "as is" and "as available", and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement;
  • we are not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, data or goodwill;
  • our total liability to you for all claims about the Service is limited to the greater of the amount you paid us in the 12 months before the claim and 100 US dollars.

Nothing in these terms limits liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence. You agree to cover our reasonable losses arising from your breach of these terms or from your use of the Service against someone else's rights.

Changes to these terms

We may update these terms. We will change the date above and, for significant changes, tell account holders by email or in the app. Continuing to use the Service after a change means you accept it. If you do not, stop using the Service and delete your account.
